We collect several different types of information for various purposes to provide and improve our Service to you.

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Phone number
  • Address, State, Province, ZIP/Postal code, City
  • Cookies and Usage Data
  • The details of your project when you ask for a quote (for example the type of release, the number of tracks and any extras), and the audio files, notes and revision requests you send us when you begin a project
  • If you accept advertising measurement in the cookie banner, the campaign tags in the link that brought you here (for example which ad you clicked), which are saved with your quote request to measure which of our advertisements generate enquiries

We may also collect information about how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.

Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

Examples of Cookies we use:

  • Session Cookies: We use Session Cookies to operate our Service.
  • Preference Cookies: We use Preference Cookies to remember your preferences and various settings.
  • Security Cookies: We use Security Cookies for security purposes.
  • Advertising Cookies: Advertising Cookies are used to serve you with advertisements that may be relevant to you and your interests.

On our campaign pages (the pages our ads link to), a banner asks whether you accept advertising cookies when you first visit. Advertising cookies and the Meta Pixel (see section 9.2) are not set on those pages unless you click "Accept," and the page works the same if you click "Reject." You can change your choice at any time with the "Cookie settings" link at the bottom of the campaign page. Your choice is stored in your browser for 180 days. The campaign page also stores your chosen currency and, if you ask it to, your preferred music service in your browser so it can remember them.

When you ask for a quote, we use your email address to send you the quote. We send promotional follow-up emails about that quote (for example a reminder or an offer) only if you opt in when providing your email address. You can stop them at any time by using the unsubscribe link in any of these emails or by emailing us at the address in section 16. You will still receive the emails needed for a project you have started with us.

Magic Garden Mastering uses the collected data for various purposes:

  • To provide and maintain our Service
  • To notify you about changes to our Service
  • To allow you to participate in interactive features of our Service when you choose to do so
  • To provide customer support
  • To gather analysis or valuable information so that we can improve our Service
  • To monitor the usage of our Service
  • To detect, prevent and address technical issues
  • To fulfill any other purpose for which you provide it
  • To send you promotional emails about our services where you have opted in, until you unsubscribe or withdraw consent
  • In any other way we may describe when you provide the information
  • For any other purpose with your consent
  • To measure which of our advertisements bring visitors and quote requests, and to show our advertisements on Facebook and Instagram to people who have visited our campaign pages, where you have accepted advertising cookies

Where EU or UK data protection law applies, we use the following legal bases.

If you are from the European Economic Area (EEA), Magic Garden Mastering legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

Magic Garden Mastering may process your Personal Data because:

  • We need to perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests and it's not overridden by your rights
  • To comply with the law

In particular: we process quote requests to take steps at your request before entering into a contract, and project information to perform our contract with you. We rely on your consent for Google Analytics, advertising cookies, the Meta Pixel, promotional follow-up emails, and collecting and using campaign tags for advertising measurement. We rely on our legitimate interests in securing our services, maintaining necessary business records and handling legal claims, where your rights do not override those interests. Where an obligation recognised by applicable EU or UK data protection law requires processing, we rely on that legal obligation.

We need your contact and project information to prepare a quote and provide mastering services; without the necessary information, we may be unable to do so. Consent to analytics, advertising measurement and promotional emails is optional.

Magic Garden Mastering will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

Magic Garden Mastering will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

In practice: quote requests that do not lead to a project are deleted after 2 years. We retain audio files and project records for as long as reasonably necessary to deliver, revise or provide agreed re-delivery of your record. Financial records are retained separately for applicable accounting and tax requirements. Campaign tags are retained no longer than the associated quote request; if you withdraw consent to advertising measurement, we stop using them for that purpose and delete or anonymise them unless another lawful retention requirement applies. Google Analytics user-level and event-level data is retained for a period of 2 months after the last use. This setting does not govern retention of standard aggregated reports. Cookie-choice retention is described in section 3.5.

For orders involving physical goods, we retain your shipping and billing information, including your name, address, and contact details, as necessary to fulfill your order, process returns, manage warranty claims, and comply with tax, legal, and regulatory obligations. This information may be retained for a longer period than other personal data to ensure proper delivery of goods and to handle any post-purchase issues that may arise.

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.

Where your information is shared with Google (section 9.1), Google is certified under the EU-U.S. Data Privacy Framework, its UK Extension and the Swiss-U.S. Data Privacy Framework. Meta (section 9.2) is certified under the EU-U.S. and Swiss-U.S. Data Privacy Frameworks; for visitors in the United Kingdom, transfers to Meta rely on the safeguards described in Meta's privacy policy. We also share information with providers of website hosting, email delivery, file storage and payment processing, located in the United States. For transfers subject to EU or UK international-transfer rules, we rely on the Data Policy Framework as outlined by our hosting partner, SelfNet.com. You can request information about these safeguards, including a copy of applicable contractual safeguards, using the contact details in section 16.

Magic Garden Mastering will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Business Transactions

If Magic Garden Mastering is involved in a merger, acquisition or asset sale, your Personal Data may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different Privacy Policy.

Disclosure for Law Enforcement

Under certain circumstances, Magic Garden Mastering may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Legal Requirements

Magic Garden Mastering may disclose your Personal Data in the good faith belief that such action is necessary to:

  • Comply with a legal obligation
  • Protect and defend the rights or property of Magic Garden Mastering
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of users of the Service or the public
  • Protect against legal liability

We may use third-party Service Providers to monitor and analyze the use of our Service.

  • Google Analytics: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. We use the Meta Pixel, a tool provided by Meta Platforms, Inc. (the company behind Facebook and Instagram).

  • What Meta receives: the pages you view on our Website, actions you take on them such as requesting a quote, and your IP address and browser and device details.
  • What it is used for: to measure which of our advertisements on Facebook and Instagram bring visitors and quote requests, and to show our advertisements to people who have visited our Website.
  • Cookies: according to Meta's Cookies Policy, the Pixel uses the cookies "_fbp" and "_fbc," which identify your browser for advertising and site analytics, and "fr," which is used to deliver and measure ads; each lasts 90 days.
  • On our campaign pages, the Meta Pixel runs only if you accept advertising cookies in the banner (section 3.5).
  • For visitors in the EU, UK and Switzerland: for the collection of this information on our pages and its transmission to Meta, we and Meta Platforms Ireland Limited are joint controllers under Meta's Controller Addendum (https://www.facebook.com/legal/controller_addendum), which sets out our respective responsibilities; Meta is solely responsible for what it does with the information afterwards. You can exercise your rights against either of us; Meta's contact details and the information about its processing are at https://www.facebook.com/privacy/policy.
  • Meta uses this information under its own privacy policy: https://www.facebook.com/privacy/policy. You can also control the ads you see in your Facebook and Instagram ad settings.

The security of your Personal Data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.

If we need to rely on consent as a legal basis for processing your information and your country requires consent from a parent, we will obtain your parent's consent before we collect and use that information.

Depending on your location and applicable laws, you may have certain rights regarding your personal information, including rights to access, correct, delete, or restrict use of your information. We honor these rights regardless of your location and are committed to providing reasonable access to the information that you have shared with us.

  • Withdraw Consent: Where we rely on your consent (for example for advertising cookies), you can withdraw it at any time, for instance through the "Cookie settings" link on our campaign pages.
